Ghost Guns in DC: What You Need to Know

December 16, 2024

The term “ghost gun” sounds like something out of a sci-fi movie, but these untraceable firearms are a growing reality, and possessing one in Washington, DC can land you in serious legal trouble. Our team is experienced as Washington DC gun lawyers and are committed to staying up to date with the latest developments.

What Exactly is a Ghost Gun?

Ghost guns are firearms assembled from parts, often purchased online or made with 3D printers. They lack serial numbers, making them virtually untraceable by law enforcement. This makes them attractive to individuals who may not be able to legally purchase a firearm, including those with criminal records or mental health issues.

The Luigi Mangione Case

The recent case of Luigi Mangione, the suspect in the killing of UnitedHealthcare CEO Brian Thompson, brought ghost guns into the spotlight. Mangione was allegedly found in possession of a ghost gun, possibly manufactured with a 3D printer. This case highlights the potential dangers associated with these weapons and the increasing concern surrounding their use in violent crimes.

Consequences of Possessing a Ghost Gun in DC

In Washington, DC, a ghost gun is a prohibited weapon. DC Code § 22–4514 makes it a felony to possess a ghost gun, punishable by up to five years in prison. If the ghost gun is used in a crime of violence, the penalties can be even more severe.

Other code sections outlaw the manufacture of a ghost gun and outline very specific requirements for obtaining a serial number for any gun created by an individual.

What to Do If You’re Caught with a Ghost Gun

If you are caught with a ghost gun in DC, here’s what you should do:

  • Remain Silent: Do not answer any questions from law enforcement without an attorney present. Anything you say can be used against you.
  • Contact an Attorney Immediately: An experienced criminal defense attorney can advise you of your rights and help you navigate the legal process.
  • Do Not Consent to Searches: You have the right to refuse a search of your person or property without a warrant.

How a DC Gun Lawyer Can Help

Skilled DC weapon offense attorneys can:

  • Challenge the Legality of the Search and Seizure: If the ghost gun was discovered through an illegal search, your attorney can file a motion to suppress the evidence.
  • Negotiate with the Prosecutor: Your attorney can negotiate with the prosecutor to potentially reduce the charges or seek alternative sentencing options.
  • Present a Strong Defense at Trial: If your case goes to trial, your attorney will build a strong defense strategy to protect your rights and achieve the best possible outcome.

The rise of ghost guns is a serious concern for public safety. If you are considering acquiring or building a ghost gun, be aware of the severe legal consequences you could face. If you are already in possession of a ghost gun, the criminal defense lawyers at Monument Legal will help you to understand your options and protect your future.
